3. OBJECT

It is the will of MOLOKA’I SUP CENTER to avoid the deliberate sending of unsolicited mail, so you may at any time, exercise your rights of access, rectification, cancellation and opposition of your personal data by ordinary mail at C/ Sant Elm, 7, 4 – 2 08003, in the terms established in the LOPD.

MOLOKA’I SUP CENTER has adopted the security levels of protection of personal data legally required and tries to install other means and additional technical protection measures. However, the User should be aware that Internet security measures are not impregnable.

MOLOKA’I SUP CENTER may use cookies when a User browses the websites and web pages of the Portal. The cookies that may be used on the websites and web pages of the Portal are only associated with the browser of a specific computer (an anonymous User), and do not provide the name and surname of the User. Thanks to cookies, it is possible for MOLOKA’I SUP CENTER to recognize the browsers of registered Users after they have registered for the first time, without them having to register on each visit to access the areas and Services reserved exclusively for them. The cookies used cannot read cookie files created by other providers. The User has the possibility to configure his browser to be warned on screen of the reception of cookies and to prevent the installation of cookies on his hard disk. To use the Portal, it is not necessary for the User to allow the installation of cookies sent by MOLOKA’I SUP CENTER, notwithstanding that in this case it will be necessary for the User to register each time you access a service that requires prior registration.

The cookies used on the websites and web pages of the Portal may be served by MOLOKA’I SUP CENTER, in which case they are served from the various servers operated by them, or from the servers of certain third parties that provide us with services and serve cookies on behalf of MOLOKA’I SUP CENTER (such as, for example, cookies that are used to serve advertising or certain Content and that cause the User to view advertising or certain Content at a predetermined time, number of times and in a predetermined manner). 8. PROCEDURE IN THE EVENT OF UNLAWFUL ACTIVITIES

In the event that any User or third party considers that there are facts or circumstances that reveal the unlawful nature of the use of any Content and/or the performance of any activity on the web pages included or accessible through the Portal, and, in particular, the violation of intellectual or industrial property rights (patents, industrial models and drawings, trademarks and trade names, etc.) or other rights, you must send a notification to MOLOKA’I SUP CENTER containing the following points:

(a) details from the complainant: name, address, telephone number and e-mail address;

(b) specification of the alleged unlawful activity carried out on the Portal and, in particular, in the case of an alleged violation of rights, precise and specific indication of the protected contents as well as their location on the web pages;

(c) facts or circumstances revealing the unlawful nature of such activity;

(d) in case of infringement of rights, handwritten signature or equivalent, with the personal data of the holder of the allegedly infringed rights or of the person authorized to act in the name and on behalf of such holder;

(e) express, clear and under the responsibility of the claimant that the information provided in the notification is accurate and of the unlawful nature of the use of the contents or the performance of the activities described.

9. NOTICES

All notices and communications (hereinafter, the “Notices”) by the User to MOLOKA’I SUP CENTER shall be deemed effective, for all purposes, when addressed to the User Service Desk in any of the following ways:

(b) By e-mail to the following address: aloha@molokaisupcenter.com

All Notifications by MOLOKA’I SUP CENTER to the User shall be deemed effective, for all purposes, when made in any of the following ways:

(a) Sending by mail to the User’s address when it has been previously notified to MOLOKA’I SUP CENTER;

(b) Sending by e-mail to any of the mailboxes that the User has or may have as part of any other service that MOLOKAI SUP CENTER provides to the User.

(c) Communication by means of a telephone call to the User’s telephone number, when the latter has been previously informed by MOLOKA’I SUP CENTER;

(d) By means of pop-up messages sent during the provision of the Services by MOLOKA’I SUP CENTER to the User.

In this sense, all Notifications made by MOLOKA’I SUP CENTER to the User shall be considered validly made if they have been made using the data and through the means indicated above. To this effect, the User declares that all data provided by him/her are true and correct, and undertakes to inform MOLOKA’I SUP CENTER of all changes regarding the notification data.

10. WITHDRAWAL AND SUSPENSION OF SERVICES

MOLOKA’I SUP CENTER may withdraw or suspend at any time and without prior notice the provision of the Services to those Users who violate the provisions of this Legal Notice.

11. DURATION AND TERMINATION

The provision of the Portal service and other Services has, in principle, an indefinite duration. MOLOKA’I SUP CENTER, however, is authorized to terminate or suspend the provision of the Portal service and / or any of the Services at any time, without prejudice to what has been provided in this regard in the relevant Special Conditions. When reasonably possible, MOLOKA’I SUP CENTER will give prior notice of the termination or suspension of the provision of the Portal service and other Services.

12. APPLICABLE LAW

Any conflict in the interpretation or breach of the provisions of this document, both parties, waiving their own efforts if any, shall submit to the jurisdiction of the Courts and Tribunals of Barcelona, and to the applicable Spanish legislation.
